Imposing limitations on contracts with MA organizations offering multiple MA plans under Medicare Section 1857 of the Social Security Act ( 42 U.S.C. 1395w–27 ) is amended by adding at the end the following new subsection: (j) Limitations on contracts with MA organizations offering multiple MA plans With respect to contracts entered into or renewed on or after the date that is 1 year after the date of the enactment of this subsection— (1) the Secretary may not enter into or renew 1 or more contracts with an MA organization under this section with respect to more than 3 MA plans offered for a plan year by such organization under this part; and (2) the Secretary may not enter into or renew 1 or more contracts with an MA organization under this section with respect to more than 1 MA plan offered for a plan year by such organization under this part unless each such MA plan is significantly different with respect to premiums, benefits, or cost-sharing structure (as determined by the Secretary). .
