II 119th CONGRESS 2d Session S. 3816 IN THE SENATE OF THE UNITED STATES February 10, 2026 Mr. Scott of South Carolina (for himself and Ms. Hassan ) introduced the following bill; which was read twice and referred to the Committee on Finance A BILL To amend title XVIII of the Social Security Act to permit a private cause of action for damages in the case of a group health plan which fails to provide for primary payment or appropriate reimbursement. 1. Short title This Act may be cited as the Repair Abuses of MSP Payments (RAMP) Act . 2. Private cause of action for damages in the case of a group health plan which fails to provide for primary payment or appropriate reimbursement Section 1862(b)(3)(A) of the Social Security Act ( 42 U.S.C. 1395y(b)(3)(A) ) is amended by striking primary plan and inserting group health plan (as defined in paragraph (1)(A)(v)) .
