II 119th CONGRESS 1st Session S. 3187 IN THE SENATE OF THE UNITED STATES November 18, 2025 Mr. Whitehouse (for himself, Mr. Padilla , Mr. Wyden , Mr. Markey , Mr. Welch , and Ms. Hirono ) introduced the following bill; which was read twice and referred to the Committee on the Judiciary A BILL To provide a civil remedy for an individual whose rights have been violated by a person acting under Federal authority, and for other purposes. 1. Short title This Act may be cited as the Bivens Act of 2025 . 2. Civil action against person acting under Federal authority Section 1979 of the Revised Statutes ( 42 U.S.C. 1983 ) is amended by inserting of the United States or before of any State .
