119 S1817 IS: Expedited Removal Expansion Act of 2025 U.S. Senate 2025-05-20 text/xml EN Pursuant to Title 17 Section 105 of the United States Code, this file is not subject to copyright protection and is in the public domain. II 119th CONGRESS 1st Session S. 1817 IN THE SENATE OF THE UNITED STATES May 20, 2025 Mr. Schmitt introduced the following bill; which was read twice and referred to the Committee on the Judiciary A BILL To amend section 235 of the Immigration and Nationality Act to treat inadmissible aliens more consistently regardless of their country of nationality, and for other purposes. 1. Short title This Act may be cited as the Expedited Removal Expansion Act of 2025 . 2. Inspection of aliens for admission Section 235(b)(1) of the Immigration and Nationality Act ( 8 U.S.C. 1225(b)(1) ) is amended— (1) in subparagraph (A)— (A) in clause (i)— (i) by striking (other than an alien described in subparagraph (F)) ; and (ii) by striking section 212(a)(6)(C) or 212(a)(7) and inserting paragraph (6) or (7) of section 212(a) ; (B) in clause (ii)— (i) by striking (other than an alien described in subparagraph (F)) ; and (ii) by striking section 212(a)(6)(C) or 212(a)(7) and inserting paragraph (6) or (7) of section 212(a) ; and (C) by amending clause (iii) to read as follows: (iii) Application to certain other aliens The Secretary of Homeland Security may apply clauses (i) and (ii) to any alien who is inadmissible under paragraph (6) or (7) of section 212(a), without limitation. Such application shall be in the sole and unreviewable discretion of the Secretary and may be modified by the Secretary at any time. ; (2) in subparagraph (B)— (A) by striking Attorney General each place such term appears and inserting Secretary of Homeland Security ; and (B) in clause (v), by striking a significant possibility and inserting clear and convincing evidence ; (3) in subparagraph (C), by striking Attorney General and inserting Secretary of Homeland Security ; (4) by striking subparagraph (F); and (5) by redesignating subparagraph (G) as subparagraph (F).
